Terms and Conditions
(Regarding use of Website and Services)
DEFINITIONS
“Provider” – means the person carrying out cleaning or pest services on behalf of Clean Weavers LLC.
“Client” – means the person, firm or corporate body together with any subsidiary or associated company to whom the cleaning or pest services are supplied by Clean Weavers LLC.
“Service” – means the cleaning or pest services carried out on behalf of Clean Weavers LLC.
“Cleaning Visit” – means the visit to the Client’s service address by the Provider in order to carry out the Service.
AGREEMENT
These Terms and Conditions represent a contract between Clean Weavers LLC and the client.
The Client agrees that any use of Clean Weavers LLC services, including placing an order for services by telephone, email or website forms shall constitute the Client’s acceptance of these Terms and Conditions. Unless otherwise agreed in writing these Terms and Conditions shall prevail over any other terms of business or purchase conditions put forward by The Client. No variation or alteration of these Terms and Conditions shall be valid unless approved in writing by a director of the Company.
You, the buyer, may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction. See attached notice of cancellation form for an explanation of this right.
OWNERSHIP
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Clean Weavers LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
INDEMNIFICATION
You agree to indemnify and hold Clean Weavers LLC harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall Clean Weavers LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Clean Weavers LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
RIGHT TO CHANGE TERMS
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify the Client that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes the Clients acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
COMMUNITIES
All users that join our community (Facebook or Discord) have a public profile that is publicly visible to site visitors, and that their public activity (such as their posts or comments) will be visible to other visitors of the community. This profile will no longer be visible if you leave the community, nor will you be able to interact with anyone else there-in.
PAYMENT
All work carried out by Clean Weavers LLC at your request, whether experimental or otherwise, will be charged accordingly. Any work undertaken by Clean Weavers LLC on behalf of The Client is carried out on the basis that The Client has fully approved such work whether or not we have received an official order providing there is evidence of written or verbal confirmation to proceed, including letter, facsimile or email correspondence between the parties.
Payments of fees rendered by invoice are due within the dates stated on the invoice.
Interest may be applied to any overdue accounts at a rate of 8.5%. Where payment has not been received, we reserve the right to withhold services, documents and information, and have the right to cease to work on your account, and to terminate the engagement if payments are unduly delayed.
Any expenses incurred whilst working on your behalf will be charged and appropriate records will be kept and will be available for inspection.
Consistent late payment will incur a 20% pre-payment for all future work.
We shall send an invoice at the time-of-service completion.
All accounts are payable no later than 7 (Seven) days from the date of invoice unless otherwise agreed on by Clean Weavers LLC in writing, such as for extended payment plans.
After 7 (seven) days from the date of invoice, if balance remains due all future appointments will be cancelled until settled.
All quotes offered by us are deemed valid for a period of 30 (Thirty) days, after which time we reserve the right to revise the quote.
We provide services on a one-time and recurring basis.
Any additional work requested that isn’t covered in the original quote will be added to the invoice at the time-of-service completion.
All service prices are reviewed each year and adjusted in line with inflation, minimum wage increases or any reasonable circumstances.
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.
QUOTES AND ONLINE SERVICE REQUESTS
Any quote provided to our clients through online booking or over the phone are just that, quotes.
If our provider finds that the quote is not in line with the scope of work required to complete a service, then it may be changed on site and the client will be notified of any changes.
The client then has the option to accept or deny this quote. However, if service cancellation is requested then a $79 inspection fee will be incurred.
If within thirty (30) days the client chooses to move forward with any of our services, the inspection fee will be credited towards the first service.
All first time or initial services require a 25% non-refundable deposit to reserve the appointment slot. Prior customers are exempt from this requirement. Reschedules are permitted outside 24 hr window.
RETENTION OF RIGHT TO CHANGE OFFERING
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
CHECKLIST & MATERIALS LIST
All services will have a corresponding checklist and materials list and will be accessible to the Client after services are completed.
EQUIPMENT
All cleaning and pest treatment supplies are provided by Clean Weavers LLC.
REFUNDS
No refund claims will be made once the cleaning service has been carried out. If for any reason the Client is dissatisfied with any aspect, they must notify Clean Weavers LLC within 24 hours and this will be rectified.
No refund claims will be made once the exterior pest control service has been carried out. If for any reason the Client is dissatisfied with any aspect, they must notify Clean Weavers LLC within 30 days and this will be rectified by performing an additional exterior service.
No refund claims will be made once the bedbug service has been carried out. This service requires effort on the Clients part as well as ours to see them eliminated. They also may not be eliminated in one service. We will do return services on a monthly basis per the severity agreement to see them eliminated. After client is deemed to be all clear of bedbugs, reinfestation several months after does not constitute a reason for refund. A new service will need to be set up and perhaps consideration for preventative services should be made.
No refund claims will be made once the roach service has been carried out. This service requires effort on the Clients part as well as ours to see them eliminated. They will not be eliminated in one service. We will do return services on a monthly basis per previous service sightings until we do two services without finding any. After this point the Client is given all clear to cancel if they choose or switch to a different service such as preventatives (initial service fee waived for prior customers). We guarantee clearance when we give all clear. If customer chooses to cancel before this is given, then guarantee is void.
Repeated abuse of call backs that are found invalid may result in termination of services.
TERMINATION
This agreement can be terminated at any time, by us or by the Client, and all future services will be cancelled.
If termination is within 48 hours of a scheduled service, the full cost of that service may be due.
Reschedules same-day may incur a service fee on next service. We send emails 4 days in advance if we have one on file and text reminders 24 hours in advance.
SERVICE WINDOW
All our services scheduled have a two-hour arrival window. If you need to adhere to stricter time constraints, we must be informed as soon as possible. We will not be held liable for any loss, monetary or otherwise, due to late arrival.
We provide clients with specialty services that most other companies do not do. Due to this, some services may take longer than anticipated.
We provide all our customers with 110% effort, including you. So, if this makes our services take longer than expected please be aware that it was necessary to complete the service to our standards.
If an hourly service is going to take longer than anticipated, the client will be informed of this before we extend beyond the original time frame and can accept or deny the extension.
REQUIREMENTS FOR SERVICE
We may not need it, however all locations requesting our service must have running water and electricity. If a service cannot be completed in full due to lack of either, the full charge for the service as quoted will still be incurred.
COMPLAINTS
We strive to ensure that the services we provide will make our clients happy with the results. If for any reason you are not satisfied with our service, please contact our office by phone 912-463-3445 or email admin@cleanweavers.com as soon as possible.
PREPARATION FOR CLEANING SERVICES
Hourly charges may be incurred if cleaning technicians require more time if your home is not ready to be cleaned or if a job is underestimated due to the condition of the home.
We are not able to clean fire damage.
If our providers do not feel safe in a home or environment, they will leave, or we will remove them.
If we are not able to clean/treat the entire space due to the conditions, you will still be responsible for the full cost of the cleaning or pest treatment.
We are equipped to clean and/or treat bug infestations, however this is a separate specialty service and is an exception to this term.
THIRD PARTY ACCEPTANCE
If you are paying for a family or friend and claim to "cancel" service but your friend or family member lets our cleaners in to clean or treat pests this assumes you still wanted service and any balance owed would be due upon receipt of services.
In order for dual accounts to be cancelled in full, BOTH parties must contact us by email/phone/text at least 48 hours before the next appointment. If one spouse "cancels" service and the other spouse and/or kids let us in to clean, this implies to our cleaners that it is OK for us to be there, and payment will be expected.
If they do turn us away at the door, see lock out information below.
CANCELLATION, RESCHEDULES, and LOCK OUT
Purchaser agrees to notify Clean Weavers LLC prior to 6pm the day before next service if a reschedule is needed. Purchaser also agrees to keep email and phone number up-to-date as changing them is not a valid reason to not get notifications of upcoming service. Email notifications go out 4 days in advance. Text reminders go out at 9am the morning before service.
Reschedules for pest control must be requested prior to 6pm the day before. If requested after 6pm the day before, it will incur an additional fee on the next service of $30 and it must be rescheduled within the week or at our next earliest available opportunity.
Reschedules for cleaning services must be requested prior to 6pm the day before. If requested after 6pm the day before, it will incur an additional $30 fee. Cancellation forfeits appointment hold deposits.
Reschedules can be requested by text to 912-463-3445 from the phone number we have connected with an account or through our service contact line 912-333-7978.
Repeated reschedules within 48 hours will result in a cancellation of all services.
Technicians turned away at the door or locked out for a service may incur a cancellation fee of 100% of service cost that must be paid before next service will be conducted.
If only the front yard is accessible to the technician for an exterior service, the service will be performed where accessible and full cost of the service will be charged, and a return service will not be scheduled until the next regularly scheduled service.
If we have to reschedule due to weather conditions or emergencies there will be no charge.
Clients do not need to be present for us to do what we do. All providers are GPS tracked and pictures are taken on site to prove presence and service completion for your peace of mind.
All cancellations will get confirmation notifications that it was completed. If you did not receive this notification, then it was not yet completed.
ALARM SYSTEMS, KEYS, & INSURANCE
It is not necessary to be at home while we are there doing the service. If you have an alarm, make sure we have the key code so we can disarm the alarm when we arrive, and set it again when we leave. We’ll also need a house key accessible to gain entry to the home. If you can lock and unlock the home remotely then this will work as well as long as you’re reachable upon arrival to gain access.
If you choose to leave the alarm armed, we are always diligent and careful to disarm and rearm the alarm according to your instructions. However, we will not be held responsible for false alarms or misuse of the alarm system, including charges from a local police department or security company or other charges related to an activated alarm. No exceptions.
Additionally, you agree to hold harmless and/or release from liability Clean Weavers LLC from any and all liability relating to any failure of the alarm or not arming the alarm properly.
We are fully licensed, bonded, and insured to provide peace of mind that your home is in good hands. A copy of these can be provided upon request.
The Georgia Structural Pest Control Act requires all pest control companies to maintain insurance coverage. Information about this coverage is available from this pest control company.
SMOKING
No smoking is permitted during service at the home by the provider or resident for interior service. If a provider decides to leave due to client smoking, the full-service charge will be incurred.
Providers will be required to step off the property to smoke during appropriate break times.
BREAKAGE or DAMAGES
Purchaser understands and agrees that Clean Weavers LLC is not responsible for damages caused by pests whether they be to property, structural or personal in nature.
We will make every effort not to break items, but accidents do happen. We have Limited Liability protection for repair or replacement. Identical replacement will be attempted but not guaranteed.
It is for this reason that we avoid cleaning requests for irreplaceable or sentimental valuable items.
Damage must be reported to our office staff by phone or email within 24 hours or Clean Weavers LLC may not be held liable.
Clean Weavers LLC cannot be held responsible for damage due to faulty and/or improper installation, lack of maintenance, or general wear and tear of any items or structure. Items that are identified as damaged prior to or during cleaning will be reported to the Client.
Key replacement fees are paid only if our providers lose the key.
SPECIAL REQUIREMENTS
Purchaser agrees to inform Clean Weavers LLC of any furniture, materials, carpeting, flooring, cabinets, coverings, drapes, siding, plants, fixtures, or other items that could be damaged by application of pesticides, baits, or cleaning products. If Purchaser fails to inform Clean Weavers LLC about such items prior to treatment, Purchaser releases Clean Weavers LLC from liability for damage to such items.
HEALTH CONCERNS
Clean Weavers LLC will apply all pesticides and baits in accordance with their labelling specifications. Clean Weavers LLC is not responsible for health problems to humans, plants, fish, or animals caused by the application of pesticides or baits applied in accordance with their labelling specifications. Purchaser agrees to inform Clean Weavers LLC of any special health conditions or concerns of persons, plants, fish, or animals at the premises during treatments called for under this Agreement. Purchaser is responsible for removal of all persons, plants, fish, or animals that may be subject to adverse health effects from pesticides and baits which are applied by Clean Weavers LLC pursuant to this Agreement. Purchaser releases Clean Weavers LLC from liability for any health effects caused to any human, plants, fish, or animal which results from ordinary care and customary use of pesticides and baits by Clean Weavers LLC.
Purchaser has been given the opportunity to inquire about the known risks of exposure to any pesticides used by Clean Weavers LLC and can access their MSDS Labelling information here
ELECTRONIC COMMUNICATIONS AGREEMENT
By agreeing to the Electronic Communications Agreement, you agree and provide your electronic signature to this Electronic Communications Agreement. Under this Electronic Communications Agreement, you agree that Clean Weavers LLC (“we” or “us”), may provide agreements and disclosures related to your Clean Weavers LLC account and all related services to you electronically (via email or on our website) instead of in paper form. During the term that you maintain an account with us, you agree to provide us with and maintain a valid email address for information that will be delivered by email and that you will promptly notify us of any change in your email address. You understand that our ability to provide you information by email is dependent upon the maintenance of a valid email address.
In accordance with state regulations, pest control companies have a responsibility to provide you with a record every time a pesticide product is applied. This record is required to be provided to the property owner, resident or custodian of the property. This record may include post-application precautionary information. ELECTRONIC RECORDS AND COMMUNICATION ACT DISCLOSURES
You consent, understand and agree that: (i) this Agreement will be entered into electronically, (ii) you meet the minimum access requirements specified below, (iii) the consent shall last until you withdraw consent, and (iv) the following categories of information may be provided by electronic communication:
• Agreements (including service agreements)
• Privacy Policy of Clean Weavers LLC
• Balance, activity and certain other information on your account
• Periodic notification of upcoming services
• MSDS records upon request
• Notifications of any changes that affect your services
• Notifications of any price increases that may affect your services (Bedbug doesn’t apply)
Consent to this agreement is a requirement of having a Clean Weavers LLC account. In order to withdraw your consent, you will need to close your Clean Weavers LLC account and cancel future services.
In order to receive the information listed above by electronic communication, you must have the following hardware and software requirements:
• A personal computer or
• A cellphone with mobile or wifi connectivity
• An email address
• A secure web browser
• Software to view documents
PHOTO AND VIDEO CONSENT
Purchaser grants permission and gives consent to Clean Weavers LLC for the use of the following photographs or electronic media images as identified below for presentation under any legal use:
Photos and videos pertaining to the treatment and removal of various pests for entertainment, educational or training purposes. No location identification or resident individuals will be included in them.
Photos and/or video pertaining to the cleaning of the home for entertainment, educational or training purposes. No location identification or resident individuals will be included in them.
You understand that you may revoke this authorization at any time by notifying Clean Weavers LLC in writing. The revocation will not affect any actions taken before the receipt of this written notice.
GUARANTEE
Clean Weavers LLC has built its business and reputation by providing its clients with the best possible cleaning and pest control service available. Still, we realize that because its providers are human beings, they sometimes make mistakes. For this reason, we offer a guarantee. If the Client is not satisfied with any areas that have been cleaned, we will come back to the Client’s premises and re-clean those areas free of charge as long as we are notified within 24 hours.
Please note that this guarantee will not apply if the condition of the premises has deteriorated since the original cleaning was undertaken.
As far as pest control, bugs are live creatures as well and cannot be eradicated in one service. If, however, there is no improvement within 60-90 days please let our office know and one of our managers will come out free of charge to evaluate the situation and work with you to find a reasonable solution.
Excessive unfound abuse of either of these guarantees will result in all service cancellations.
AUTHORITY TO EXECUTE
The individual signing this agreement, as Purchaser or on behalf of Purchaser; hereby asserts that he/she has authority to enter into this agreement and agrees to be personally responsible for all amounts due to Clean Weavers LLC under this agreement.
COMPLETE AGREEMENT
This agreement constitutes the complete Roach Service Agreement between the parties and all prior discussions or communications between the parties are merged into this written agreement. This agreement is controlled by Georgia Law.
